This agreement is between you (the "Participant", or the parent/guardian signing for a minor) and Angat Technical Solutions LLC (in formation), doing business as RallyTime Academy, its owner and coach Jomel Angat, and its members, employees, contractors, and agents (together, "RallyTime Academy"). It covers every pickleball lesson, clinic, class, group session, bundle session, and related activity ("Activities") that RallyTime Academy provides, whether at Life Time, another facility, a public court, or a private court.
Please read it carefully. By checking "I have read and agree to the Participant Waiver" you agree to all of it.
Pickleball is a physical sport. I understand that taking part involves risks, including but not limited to:
I understand that these risks cannot be fully removed, even with reasonable care. I knowingly and voluntarily accept these risks and choose to take part.
I confirm that I am physically able to take part, and that I have no medical condition that makes taking part unsafe for me, or that I have been cleared by a doctor. I am responsible for knowing my own limits, warming up, staying hydrated, wearing proper court shoes and protective eyewear if I choose, and stopping immediately and telling the coach if I feel pain, dizziness, chest discomfort, shortness of breath, or anything unusual. I will tell the coach about any condition, injury, or medication that could matter during a session.
To the maximum extent permitted by law, I release, waive, and agree not to sue RallyTime Academy for any injury, illness, loss, or damage (including to property) arising from my participation in the Activities. I understand some states, including Virginia, may limit or not enforce this release, especially for negligence. If so, this section applies only as far as the law allows, and the rest of this agreement still applies. Nothing in this agreement releases claims for gross negligence or willful misconduct.
To the extent permitted by law, I agree to cover (indemnify) RallyTime Academy for claims, costs, and reasonable attorney's fees brought by anyone else that arise from my own conduct during the Activities, or, if I sign for a minor, from that minor's participation.
If I am injured or become ill and cannot consent, I authorize RallyTime Academy to call emergency services and to arrange first aid or emergency medical care for me (or my minor). I am responsible for the cost of any treatment and transport. RallyTime Academy is not obligated to provide medical care beyond calling for help and basic first aid.
If the Participant is under 18, a parent or legal guardian must accept this agreement for them, enter their own full name as guardian, and agrees to every section on the minor's behalf and on their own behalf. The guardian confirms they have authority to do so. A minor may not accept this agreement for themselves.
Separately, and only if I check the optional photo/video box, I allow RallyTime Academy to take and use photos or video of me (or my minor) during Activities for coaching feedback, social media, the website, and promotion, without payment. I can withdraw this permission for future use at any time by emailing the coach. Not checking the box does not affect my booking; video taken only for my own coaching feedback is shared only with me.
I will follow the rules, posted policies, and staff instructions of every facility where Activities take place (including Life Time and any other club, park, or court), as well as the coach's safety instructions. The coach may stop or remove me from a session for unsafe behavior.
For lessons on a private court (for example, a home, HOA, or club court arranged by a participant), the property owner or the person who arranged the court is responsible for the condition and safety of that court and property, and for any required permissions and insurance. RallyTime Academy does not own, control, or maintain those courts. The coach may decline or stop a session if conditions look unsafe.
This agreement is governed by the laws of the Commonwealth of Virginia. If any part of it is found unenforceable, that part is limited to the extent necessary or removed, and the rest remains in full effect. This agreement applies to all Activities from the date I accept it until I am asked to accept a newer version.
I agree to sign this agreement electronically under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Virginia Uniform Electronic Transactions Act. Checking the box and submitting my booking is my signature and has the same effect as a handwritten signature. RallyTime Academy records my name, phone, email, the version of this agreement, the date and time, my IP address, and my browser information as a record of my acceptance. I can request a copy at any time, and I can print or save this page.
I have read this agreement, I understand it, and I am giving up substantial rights by accepting it. I accept it voluntarily.
Separate from the waiver above; it is not part of the waiver's acceptance text.
1) Life Time members (Life Time-billed sessions): As per Life Time policy.
2) Non-members at Life Time: Cancel 24+ hours ahead for a full refund or credit. Inside 24 hours, 50% is charged. No-show, 100% is charged. If your spot is filled, you get full credit.
3) Lessons at your court: Cancel 24+ hours ahead and the lesson fee is refunded; any court fee already paid is the player's either way. Inside 24 hours or no-show: the full lesson fee plus your court share.
4) Rain or closed court (all): If Jomel cancels for weather, you get a free reschedule or a full refund, including the court fee whenever the club refunds it.
